Hunter Biden, who has no prior criminal history, has reached a plea deal that would avoid jail time for a gun-related charge. This has led to some conservative commentators claiming that the president’s son is receiving special treatment. They are misleadingly equating his case with that of South Florida rapper Kodak Black, who had a criminal record before receiving a 46-month sentence for two gun-related charges.

According to a report by Factcheck.org, Black, whose real name is Dieuson Octave and also known as Bill K. Kapri, has a criminal record that started in his teens. He spent time in juvenile detention and has charges in at least three states – Florida, South Carolina, and New York. In comparison, Hunter Biden has no prior criminal record.

In 2019, Black was charged with making false statements while trying to purchase guns, similar to one of the charges against Hunter Biden. Black had lied on the required Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) forms, stating that he hadn’t been charged with a felony when he actually had. This violated federal law and resulted in a sentence of three years and 10 months for Black. Additionally, Black had a prior felony conviction for a violent crime.

However, Black’s sentence was commuted by former President Donald Trump, and he ended up serving only a year and nine months. This has raised comparisons to Hunter Biden’s case, with some suggesting that Biden is receiving special treatment because of his father’s position as president.

Biden, in contrast, has reached a plea agreement with prosecutors, which, if approved by a judge, would allow him to avoid prosecution on his gun charge. The agreement includes requirements for him to stay drug-free and not own a gun. The maximum sentence for the gun charge is 10 years.

It’s important to note that the circumstances of Black’s and Biden’s cases are different, making a direct comparison difficult. The Wall Street Journal examined over 100 cases with similar charges to Biden’s and found that few were comparable. In the few cases involving a single firearm offense, other factors like previous criminal history were involved.
