A judge has declined to overturn the conviction of a police officer who stored a service rifle and ammunition in his bedroom closet.

Edmonton Police Service Const. Hunter Robinz was convicted last August of careless storage of a firearm after a trial that included domestic assault allegations from a former romantic partner.

Provincial court Judge Peter Ayotte acquitted Robinz of the assault charge but fined him $1,000 for the weapons offence, concluding it was unreasonable for Robinz to store an unlocked carbine in his bedroom closet with two clips of ammunition. Robinz — who is currently suspended without pay pending an internal investigation — had been on desk duty due to another disciplinary probe and had been ordered to surrender his service weapon.

Court of King’s Bench Justice John Henderson heard an appeal of Ayotte’s decision and concluded Tuesday the lower court judge made no legal errors.

Robinz had sought to have the conviction overturned, or the sentence reduced to a conditional discharge — which if completed would have meant no criminal record.

Henderson, however, found no issues with Ayotte’s decision. He said keeping such a weapon unsecured in a closet is a “marked departure from the steps a reasonable person would take.” He also concluded a $1,000 fine was not “demonstrably unfit” in the circumstances. 

Robinz is set to start a trial this fall on four separate charges including sexual assault. The Alberta Serious Incident Response Team charged him in late 2021 with sexually assaulting a 24-year-old woman while in uniform and on-duty on June 29, 2019. He is also accused of seeking sex from female victims of crime.

Robinz remains suspended without pay. He is next due in court for an arraignment June 23.
